VISIT OF CE TO MOD

CE of NDGBGOA visited MOD on 25/11/2013. CE of NDGBGOA has discussed various issues with UNDER SECRETARY DFy-I of MOD are as follows:-

1) Promotion increment for CM-II to CM-I & AF to JWM, those who are promoted between 01/01/2006 to 01/09/2008   

                  Regarding this issue UNDER SECRETARY D-Fy-I of MOD  assured to take up the matter with Financial Division of MOD as well as MINISTRY of FINANCE.

2) MACP in promotional hierarchy( removal of GP 4800/-) 

                   In this regard MOD has replied that, there is a meeting held at DOP&T in which Chair Person was Dr. S.K.Sarkar, Secretary/Personnel of DOP&T, the issue was discuss & published in Record Note of the meeting held on 24.10.2013 at 3.00 PM to discuss the possible Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM, the issue was discussed as 'Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/ 4/ 2007. These judgments should be implemented to all similarly placed employees', accordingly DOP&T has taken the case & order will be publised by DOP&T soon.

BRIEF OF THE JOINT MEETING WITH JS/MOD AND OFB OFFICIALS AT OFB ON 30/10/2013

       NDGBGOA MEETING WITH HONORABLE Jt. SECRETARY/P&C HELD AT ORDNANCE FACTORY BOARD KOLKATA on 30.10.2013 at 1500Hrs in presence of MEMBER/PER AND OTHER OFB OFFICIALS.

      Addressing the house Sri S.K. Singh,DIR/IR, welcomed Jt. Secretary /MOD, Member/per and other OFB Officials. He welcomed all the NDGBGOA representatives.
General Secretary, Sri Jaigopal Singh addressed the house and thanked the Defence Secretary (Production) for his initiation for the joint meeting. He also thanked Jt. Secretary (MOD), Member/Personal and other OFB Officials for extending their support and sparing their valuable time.
 The point wise discussions are as follows
1.      Cadre Review for Group’B’ Gazetted Officers(JWM Tech/Non Tech and PS)
        OFB’s Comments: The Officials expressed that OFB had submitted the cadre review proposal to MOD on 09.10.2013.
       The GS/NDGBGOA expressed his deep concern about the submission of the cadre review proposal without taking the consensus of the Assn. He also brought to the notice of the house that NDGBGOA had already submitted the cadre review proposal to MOD and OFB. He requested the house to discuss regarding the proposal which has been sent by OFB to MOD.
      Jt. Secretary (MOD) asked the OFB to submit the house about the OFB submitted cadre review proposal.
     OFB replying to the point stated that they have recommended for Rs 5400 GP in PB II for JWM (SG) (2730 post) for meeting the functional requirement in Ordnance Factories.
      NDGBGOA strongly protested the OFB proposal and demanded to create Rs 5400(Section Manager) and Rs 6600 GP in PB-III (Sr Section Manager) in JWM Cadre as proposed by NDGBG Assn.
        After threadbare discussion, Jt.Secretary directed OFB to re examine the submitted proposal. She replied that recently there was order from Ministry of finance regarding financial position and non creation of post in Govt organization. As there was an injustice to the JWM cadre in 6th CPC, she promised to take care for JWM Cadre in 7th CPC. First of all we should try our best in DOP&T and MoF to get 5400 PB II for JWM (SG) (2730 post).Finally Assn has demanded to get Grade Pay of 5400 in PB III for JWM (SG) (2730 post) and 5400 PB II for rest of the JWMs. Joint Secretary (MOD) assured to take up the matter in DOP&T and MoF. 
     GS/NDGBGOA requested Jt. Secretary that before finalization of the cadre review proposal or any other points concerned to Group B cadre; the same may be discussed with two Associations (i.e. NDGBGOA and IOFGOA). Jt. Secretary directed OFB to take consensus of the two Assns before finalization of any points pertains to Group B cadre.
              GS/NDGBGOA requested to maintain parity in percentage of post with respect to technical and non technical in JWM Cadre. After implementation of 5th CPC ,MOD (vide letter no-41/1,2002/III/D FY(II) dated 1st October 2002) has redistributed the post of JWM (Technical-2609 post) and JWM(Non Technical-131 post) in the ratio of 15% and 5% respectively as a result there is a stagnation in promotion from CM/NT which clearly shows the discrepancy. Therefore same ratio should be maintained in  JWM (Technical) and JWM ( Non Technical) in the cadre review.  
            GS told that PS cadre review is required at par with the OFB and MOD. Jt. Secretary stated that the cadre review proposal for PS already has been approved by MOD in consultation with Ministry of Finance. Hence in this stage the same cannot be changed and the ASSN submissions will be reviewed in the later stage.
  
2.      Nature of Duties of JWM(T/NT)  may be published in all Ordnance Factories:

    OFB while replied that as per functional requirements the JWM’s are to be deployed in the factories by the concerned GM’s.From Assn side, Org. Secretary expressed his objections and submitted to the house that during the year 1984 CM to FM duties were published by OFB. Afterwards many changes in the middle management cadre have been occurred in Ordnance Factories but OFB is not at all concerned on this issue. In 2008 OFB has published duties and responsibilities of Group A Officers (AWM to GM) in which it has been mentioned that the duties of HOS (JWM) is being performed by AWM’s and WM’s which shows contradictory.Org. Secretary brought to the notice that as per RTI act Responsibility and Accountability of each cadre should be published by the all the organization but OFB is least bother regarding it. He also stated that due to non publication of duties of JWM’s they were deprived neither as a Gazetted officer nor they are allowed for other benefits which are given to other cadres like OT and NDA etc.After elaborate discussions Jt. Secretary instructed OFB to publish the duties of JWM’s.

3.      MACP Benefit to be given to  JWMs and PS as per Promotional Hierarchy:
 OFB stated that based on the various court verdicts, OFB had sent a proposal vide  letter No. 01/6th CPC/MACPS/PCC(A/A) (Pt) Dated 16.09.2013 to MOD for taking up the matter with DOP&T for a decision, A reminder had also been sent on 27.09.2013.

             Jt. Secretary stated that MOD will take up the matter with DOP&T for early finalization and for publication of the same.

5.      Removal of Anomalies in Promotion from JWM to AWM promotion in O.F.Board:
           OFB had stated that already 76 promotions from JWM to AWM has cleared and for  promotion. from JWM to AWM,  around 210 AWM vacancies proposal was  already forwarded to MoD for further action.

6.      Annually Publishing of Seniority List of JWM (T/NT) and PS.

OFB stated that they will publish the Seniority List within time. GS told that promotion/seniority/service conditions of JWMs(7694) are being carried out by A/NG section along with Chargeman and OS(1300) as a result there many discrepancy and problems being faced by the cadre. Due to heavy workload the A/NG is not in a position to complete the task within the time frame. Hence separate section for JWM’s are to be formed or the same to be shifted to A/G Section’.OFB stated that they will look in to the matter by either increase in strength in A/NG section or to open new section.
7.      Revision of SRO and recruitment Rules for JWM (T/NT) and PS:

OFB replied that the proposal for revision of RR/SRO for PS is submitted to M of D for consideration and onward processing with DOPT and other agencies.
The drafts SRO/RR for the post of JWM (T) and (NT) have already finalised and shall be submitted to M of D shortly.In that OFB replied that description Ministerial cadre has already been removed in the SRO.The GS told that before finalization SRO/RR the our Associtions views should be taken in to consideration.  
JS/MOD instructed DDG/NG/OFB to finalize the SRO by consulting both the Associations before finalization.
Assn demanded for provision of LDCE for the post of AWM from JWM cadre like in IPS cadre.Moreover talented people from JWMs are quitting the job and going for other department which can be stopped and utilised for our organisation. JS/MOD replied that this proposal will be examined and accordingly further action wil be taken. 
7. Revoke cancelled transfer orders of JWM before implementation of transfer policy. All transferee JWMs may be released:
                  While replying OFB stated that revised transfer policy is under finalization with OFB. After finalization of the same all the pending transfers are to be considered.
                    GS strongly protested the OFB stand and asked to release the pending transfer orders which are cancelled by OFB. Due to unilateral decision of OFB the pending transfer JWM’s are suffering a lot and he also requested that before finalization of the new transfer policy they should be released.
                   JS instructed DDG/NG that the demand of the Assn is genuine and asked to release the pending transfer cases which are cancelled by OFB.
DDG/NG stated that the representations which have received for consideration in the cancelled transfer order cases will be release immediately.   
8. Granting of PLB  to Group’B’ Gazetted Officers(JWM and PS).
           OFBoard replied that as per Govt. Order Gazetted Officers are not eligible for PLB. In this regard Assn demanded that it should be reviewed at present depending upon the nature of work performed by different cadres. There was an order from MOD in the year of 2000 that all the Non Gazetted employees should be paid PLB depending upon the nature of work performed during that period but it has not been reviewed now.
Finally Joint Secretary asked OFB to forward the recommendation which will be examined at MOD.
9. Restoration of Unauthorized withdrawal of Promotion Benefits i.e Incremental Benefit who have earned   promotion after 1-1-2006 to 29-08-2008 before implementation of 6th CPC Report.
       OFB replied that there is no instruction to restore the incremental benefit who earned from 1-1-2006 to 29-8-2006.After deliberate discussions on this point, JS/MoD told that she will examine the matter.
10. Set up of Separate Mechanism for settlement of Grievances of Group’B’ Gazetted Officer.
          NDGBGOA strongly demanded a separate forum for resolving the issues of Group B gazette Officers are having many cadre related problems after implementation of 6th CPC in Ordnance Factories. It should be resolved by a separate mechanism; otherwise the important middle management cadre will lose their morality.   
        After deliberate discussion JS (P&C)/MoD conveyed that there will be quarterly (once in three months) joint meeting (MOD, OFB and Assn) at OF Board for resolving the issues of Group B Gazetted Officers. General Secretary requested that both Assn (NDGBGOA & IOFGOA) should participate in the meeting.

 The meeting ended with vote of thanks to MOD officials and OFB Officials by Org.Secretary/NDGBGOA.

               Reference cited, the Central executive of NDGBGOA requests you to include following points in the proposal of transfer policy framed by OFB for Group ‘B’ Gazetted cadre.
              With reference to the above, it is most unfortunate to note that the Circular published in OFB Comnet regarding the Transfer Policy of JWMs /PS cadre has been distributed to leaders of the Federation/Unions who are not having role in the subject activity or involvement in policy decision making of Gazetted Cadre & not to the feeder group (Group ‘B’ Non Gazetted Cadre). The above act is amount to ignoring the decorum of the Gazetted Officers and against the spirit of protocols maintained. It is strongly condemned by this Association and it is requested not to involve Federation/Unions in future for policy decision of Gazetted Officers.
 First of all, it is a matter of concerned that Ordnance Factory Board is not strict compliance to any of the transfer policy published till date. The transfer of group B officers is being ordered according to the whims and fancy of OFB. The genuine compassionate ground transfers are regretted for years together where as many JWMs are able to get transferred to the required station within very short periods. Therefore this association requests you to implement the transfer policy in a transparent manner. For transparency in transfer Order following points may kindly be considered.

             This association requests you to consider followings point’s for inclusion in Functional Ground transfer and Request transfer of Group ‘B’ Gazetted officers.

Transfer on Functional Grounds
(a)  10 years of service.
(b)  As far as possible JWM/Tech. (except Civil)may be considered for transfer in the same technology group of factories.
(c)   JWM/Civil, JWM/NT, Sr. PS / PS can be considered across the technology grounds but in nearby stations to the extent possible.
(d)  If a JWM has less than 5 years’ service left, he should not be considered for transfer, unless there is a request or administrative exigency, which may be recorded.
(e)  Transfer should be delinked from promotions.
(f)   Transfer may be considered normally twice in a year.
·   Willingness from JWM/PS should be taken well in advance i.e. 02 months before being transferred on Functional Ground.
·   All the transfer on Functional Grounds should be mandated in Public Interest only.
·   Initially directly recruited CM & JWM should be posted to hard stations at least for 5 years.
·   No Transfer should be done from hard station to hard station without willingness of individual.

Request Transfers
(a)   Request for transfer from employees suffering from terminal ailments shall be given priority.
(b)  While considering other request for transfer GOI instructions on spouse cases, physically challenged, mentally challenged family members etc. will be followed.
(c)   The officer should complete at least 3 years tenure in a particular station, before his request for transfer can be considered.
(d)  All the requests for transfer (other than those suffering from terminal ailments) should be considered by determining their relative merits on point score for different grounds of compassion.
·   There should not be any point system for considering transfer on Compassionate Ground.
·   Any transfer may be ordered by considering the service in a particular cadre not according to the station seniority.
·   The eligible service for transfer to softer station should be 5 years minimum.
·   For transparency, applicants list applied for transfer on compassionate grounds should be published in the OFB web site in an order of seniority (according to the date of request of transfer application) with remarks of the final authority and transfer orders should be published according to the seniority list.
·   While considering Compassionate Ground the willing application should be considered at first, there after the grade seniority should be considered.
·   The Chairman/DGOF may kindly consider transfer in compassionate ground for few extraordinary urgent cases of Health (Health of employees or dependent) and other circumstances without considering tenure in the station and marks as mentioned in the proposal.
·   The GMs/Sr.GMs of Ordnance and Equipment Factories should have lenient view towards forwarding applications of the individuals who are requesting transfer on compassionate ground.

·   OFBa& CFA should be included in the list of hard station as previously published Transfer Policy in the year 2004 & as discussed in board meetings recently.


As both the factories are situated in remote areas i.e. OFBA(65 Kms) & CFA (90 Kms)  away from City area. To avail  the  facilities like Education & health-care, most of the sufferer employees & their dependent have to travel a long distance from the Factory Premises.

Competent Authority
·    All transfer whether on functional ground or on request will be issued with the approval of DGOF & Chairman, OFB.
·    Compassionate transfers will be considered, keeping in view, the smooth functioning of the factory/unit concerned.
·    Notwithstanding above, DGOF & Chairman, OFB reserve the right to order any transfer on administrative & functional grounds.




              NDGBGOA requests followings points which may kindly be included for better implementation of transfer policy.
1-      The transfer policy should be transparent.
2-      Preference should be given for mutual transfer in Group ‘B’ Gazetted Cadre who ever are interested, without considering the tenure of services in a station.
3-      As Group ‘B’ Gazetted Cadres (multi skilled) are utilized in factories/units in different stream, so the transfer should not be restricted to particular group of factories. Transfer may be considered in zonal basis according to the functional requirement of Group ‘B’ Gazetted cadre as whole without considering the stream.
4-      Transfer orders should be published with PDC, The Chairman/DGOF shall ensure the release of JWM/PS from the Units to the new station after publication of transfer order. Thereafter further transfer order should publish.
5-      All the General Manager/HOD should forward the application of request transfer of JWM/PS to The Chairman/DGOF for consideration without any delay.
6-      Transfers of individuals from hard station to hard station should be willing not rotational.
7-      Request of transfer to NATIVE place from hard station should be considered after the completion of minimum 5 years of service period.
