                        MEETING WITH JOINT SECY/MOD ON 12/02/2013


DEAR FRIENDS,
                           The office bearers of NDGBGOA discussed following points along with Joint secretary/MOD (DP) on 12/02/2013.

1- Recognition of NDGBGOA-Recognition paper has been cleared by JOINT SECRETARY and forwarded to Additional Secretary which will be submitted to D JCM within this week.

2-CADRE REVIEW- Regarding cadre review there was a brief discussion and our association pointed out that there is negligible aspects for a Group B Gazetted officer to get a promotion to  group A organised cadre even after completion of more than 12-14 years of service as JWM. IT is brought to the notice of Joint Secretary that there is only 187 promotional posts are existing for a 7700 JWMs which is negligible.Moreover the cadre review committee report is not being forwarded by OFB till date.Finally Joint Secretary/MOD(DP) assured  that with consultation of assn cadre review will be finalised. The promotional avenue of JWM cadre will be taken care in cadre review.
3- NATURE OF WORK OF JWMs- Regarding nature work of JWMs it was brought to the notice of JS that all the JWMs are demoralised day by day in the OFB due to the lack of promotional avenue, less financial benefits and there is no clear instruction on nature of work to JWMs. One way JWMs are designed as a Managers but forced to perform supervisory staff in round the clock without any financial benefit of Night Duty Allowance.Joint Secretary/MOD(DP) assured  to study the case and will visit all the Factories for feasible solution. Regarding nature of work and SRO of JWMs, the matter was discussed with Deputy Secretary and Under Secretary.It was brought to their notice that the letter issued by MOD, Dept of production and supply t in 1st october 2002  regarding supervisory staff  and SRO indicates  JWM as Group B gazetted (Ministerial) which means clerical job. Finally under secretary assured that this issue may be taken up by association and forwarded to MOD for removal of the letter issued in 2002 and ministerial from the SRO. In this regard assn has made the letter to MOD which will be sent in this week.
4- Cancellation of transfer of JWMs- Regarding the last Cancellation of Transfer Order of JWMs JS/DP assured that it will be reinstalled shortly and the matter will be taken care at the earliest.

 NON PARTICIPATION OF NDGBGOA IN STRIKE

               There is  a strike called by all the federation on 20th and 21st February 2013.
It is brought to your kind notice that as per the directives of CENTRAL EXECUTIVES our association will extend its moral support without supporting physically towards the strike called by all the federation which is scheduled on 20th and 21st Feb 2013.

All the Branch Chairman and Secretary are requested to convey the massage to all the members of branch association regarding non participation in strike.

OFFICE MEMORANDUM

Subject:- Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case. inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10)to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

2. In terms of this Ministry’s OM No. 169/2/2000-IC dated 24.11.2000, dealing with the situation whereby both the feeder and the promotional grades were placed in the identical revised pay scales based on the recommendations of the 5th Central Pay Commission, it was provided, inter-alia, that only in cases where it was not found feasible to appropriately restructure cadres in question on functional, operational and administrative considerations, extension of the benefit of fixation of pay under FR 22(I)(a)(1) could be considered on the merits of each case, provided all the conditions precedent for the grant of this benefit were fully satisfied and promotion to the post in question actually involved assumption of higher responsibilities.

3. In view of the provisions which existed prior to 1.12006., the matter has been considered and the President is pleased to decide that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the fixation of pay in such cases will be done in the manner as prescribed in Rule 13(i) of the CCS(RP) Rules, 2008, provided fixation of pay in such cases was done prior to 1.1.2006 in terms of this Ministry’s aforesaid OM No.169/2/2000-IC dated 24 11.2000.

4. In so far as the persons serving the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

MINUTES OF CEC MEETING OF NDGBGOA HELD ON 12TH AND 13TH DECEMBER 2012 AT OCF, SHAHJAHANPUR

MINUTES OF CEC MEETING OF NDGBGOA HELD ON 12TH AND 13TH  DECEMBER 2012 AT OCF, SHAHJAHANPUR
The inaugural function of NDGBGOA and the annual general body meeting of NDNGSA was held together at Ordnance Club at 1030 hrs.  The function was inaugurated by lighting of lamp by the chief guest  Shri A. RoyChaudhary, IOFS, General Manager, OCF Shahjahanpur followed by the other dignitaries Shri. S.K. Bannerjee, AGM, Shri.S.K. Sinha, AGM, Shri. D.K. Chowdhry, President/NDNGSA, Shri. V.S. Randhawa, General Secretary, NDNGSA, Shri. Jaigopal Singh, General Secretary/NDGBGOA, Shri. N.K.Singh, CEC Member/NDGBGOA and Shri.U.C. Jaiswal, Organising Secretary/NDNGSA.
The welcome speech was delivered by Shri. A.P. Gangwar, JWM/OCF, Shahjahanpur (Branch Patron).  He has highlighted the efficiency of the General Manager for getting and achieving more target for OCF Shahjahanpur. 
The Chief Guest of the function Shri. A. Roychaudhary, General Manager/OCF Shahjahanpur addressed the gathering and stressed on the need that our thinking should be first for the nation, second for the organization and third for the cadre.  So we can improve our organization altogether by betterment of the organization and betterment of the cadre.  He wished all the best for the meeting which will sort out many cadre related problems.
Shri. D.K. Chowdhry, President/NDNGSA expressed his sincere thanks to the General Manager/OCF Shahjahanpur for giving his kind co-operation for conducting the 2nd CEC meeting of NDGBGOA & the annual general body meeting of NDNGSA 2012 at OCF Shahjahanpur.  In brief, he pointed out that there should be LDCE exam for AWM post by which many talented youngsters can be absorbed in our organization those who are trying for  employment in other departments.  
Shri. Jaigopal Singh, General Secretary/NDGBGOA addressed and pointed out that the sixth central pay commission has done injustice to the middle management cadre for which we have to resolve our issues by approaching court of law as department is not able to solve our issues.  He pointed out that there should be an institute In Ordnance Factories like NDA to get young talented officers in our organization. The inaugural function was concluded by vote of thanks by Shri. N.K. Singh, Branch Secretary.
The business session started at 1430 hrs.  General Secretary submitted his report.  In his report he has mentioned about the pay fixation court case which is pending at CAT, Jabalpur and the next hearing will be on 18th February 2013. 
He congratulated all the branches for getting verified membership of more than 22% and mentioned that recognition papers are pending at MOD, New Delhi which we may expect within a month.   He mentioned about the cadre review of JWM  where our demand is Grade pay of Rs. 5400 Jr. Manager and Rs. 6600 for Sr.Manager. Ordnance Factory Board utilizing JWM Cadre as per their whims and fancy wherever required.  The JWMs are being used for Orderly Officer, Divisional Officers as well as Plant Operators in Shifts.  There is no clear instruction regarding the nature of work. For which,  NDGBGOA, CFA Branch has taken up the issues at CAT, Chennai. The honorable CAT, Chennai has passed the order and directed Chairman, OFB for giving directives regarding nature of work and admissible financial benefits to be granted to JWMs. 
The following agenda points were discussed and the decisions were taken in the house unanimously.
1.        CADRE REVIEW : Regarding cadre review, General Secretary pointed out that cadre review committee formed by OFB submitted the report and given a proposal of 5 grade structure in Group – B cadre. In that proposal, the committee recommended proposal, it has been mentioned to keep JWMs in 2 grades at PB-II 5400 GP & PB-III 5400 GP which will not have any benefit in promotion for JWMs.  Therefore, our association will take up the issue and  will demand Jr. Manager  at PB-III 5400 GP & Sr. Manager at PB-III 6600 GP. 
Shri. Velayudhan, Secretary/ OFT branch pointed out that they have submitted a letter to Chairman, OFB regarding cadre review and  matter may be taken up CE.  If required, Trichy branch will take up this  issues to Court of Law.
2.       SENIORITY LIST OF JWMs : Shri. VK Shrivastav, Jt. Secretary mentioned that the order issued by DOPT on 13.09.2012 that DR JWMs who were joined  between 01/01/2006 and 29/09/2008 will be senior than the merged JWMs and it is a matter of concern. CE directed that those are interested, they can approach the court of law. Moreover in this regard Central executive will issue a letter to the Chairman/OFB to publish seniority list as per guidelines of DOP&T presently.
3.       STATUS OF COURT CASE ON PAY FIXATION AS PER FITMENT TABLE AND REGARDING NATURE OF WORK OF JWM:  The argument will be on 18/02/2012 at CAT,Jabalpur. Jt Secretary V.K.Srivastav has told that there is much chance that we will win the case.  Regarding nature of work and financial benefit to JWM,Organising Secretary Sri B.M.Barik  told that CAT,Chennai has passed the order to direct Chairman/OFB for issuing order on the representations of NDGBGOA which was submitted on 15.05.2012.
4.       RECOGNITION STATUS OF NDGBGOA :  General Secretary told that more than 20% verified strength was forwarded by OFB to MOD. He mentioned that recognition papers are pending at MOD, New  Delhi which  may be cleared  within a short period.
5.       REMOVAL OF GRADE PAY OF Rs.4800 in MACP: Presently DOPT has appointed a committee for study of this problem, after final orders by DOPT. Central  Executive directed that all the branches  will give representations to chairman/OFB and finally it will be taken up by Avadi group of factories to Court of Law if required.
6.       LDCE EXAM FOR AWM from JWM : Central Executive will take up with Chairman / OFB for making LDCE. Exam from JWM to AWM. The selection process should be made through UPSC . The qualifying service for JWMs may be considered as 3 years.
7.       JOINING To THE CONFEDERATION OF CENTRAL GOVERNMENT GAZETTED OFFICERS ORGANIZATIONS : In this regard,  Shri. Velayudhan Secretary/OFT, Shri. P. Thangapandian, Secretary/HVF have explained about the first convention of that Confederation in which NDGBGOA office bearers of Avadi group & Trichy attended.  The house has unanimously authorized General Secretary/NDGBGOA to take a decision after collecting bye-laws of confederation.  The donation of Rs.6000/- given for the convention was paid by Central Executive.
8.       AGITATION PROGRAMME : As JWMs are treated by OFB in a different manner for the nature of work,  financial benefit and even in the last cancellation of pending Transfer orders.  Therefore, house unanimously taken a decision for making a week long agitation programme for the above issues.  If  required, combined agitation programme along with IOFGOA will be carried out.
9.       INCREAMENT TO JWM : CE will issue a letter to Chairman/OFB to re-install the increment to the JWMs those who have promoted as JWM from Asst. Formeman and CM-II to CM-I after 01.01.2006 till the acceptance of 6th CPC order based on DOP&T Order Dtd.13.09.2012 published for Seniority clarification.
10.   MEMBERSHIP DRIVE : The house unanimously made a committee for membership drive for the year 2013-2014 along with Zonal Secretaries.

11.   O.T Arrears to JWMS those who have promoted from CM : The O.T Arrears to the JWMs those who have promoted from CM has not been granted since the promotion was granted with notional effect. CE will take up the issue with OFB.
12.   Forwarding of application through proper channel for employment in other departments including UPSC should be allowed and the present policy followed by OFB  shall be waived away.
13.   In order to equip the Ordnance Factories in the field of indigenous production to meet our defence requirements and also to utilize the infrastructure available in OrdnanceFactories, attention should be given to improve the skill of personnels of OFs at all levels as follows:

a)      Industrial cadre should be provided with exposure to higher level manufacturing techniques in all core competency areas by re-instating the ATS/SCT/SATS schemes which were prevailing in OFs at centres like Ambarnath, Ambajhari, Avadi etc.
b)      IOFS entrants of DR should be allowed to acquire and master in production techniques through core competency training by attaching with the experienced JWMs of respective units/shops through which their leadership can take the organization in right direction in meeting our defence requirements indigenously and also though quality outsourcing.    
14.   Direct Recruitment of AWMs should be kept pending till the DPC of the existing JWMs is finalized to effect the promotions to AWMs.
15.   As Shri.Karunanidhi, Vice President is pre-occupied with his personal commitment, Shri. A. Kannan unanimously nominated as Vice President/NDGBGOA, CE In place of Shri. Karunanidhi based on his request. The fresh  NDGBGOA Office bearers list for the period 2013 are given below.

The Second day session was started on 13.12.2012 at 10:30 and Treasurer Report was submitted by Shri S.B.Gaur,Treasurer/NDGBGOA .Treasurer Report was proposed by Shri. Thangapandian,JWM/HVF and Seconded by Sreekumar,JWM/HAPP,Tirchy. Meanwhile General Secretary  h/o Cheque of amount Rs. 25000/- to General Secretary / NDNGSA(CE) along with Balance sheet regarding  BGCM Balance amount  and Rs.10000/-  Cash given to D.K.Chaudhary  for Court cases. Rs. 25000/-has been deposited in NDGBGOA (CE) A/c.
General Secretary informed that O.F.Board is in the views for Renaming of CM and JWM .The house unanimously decided that name of JWM should not be changed.
        The house has passed the following resolutions unanimously.
1.       The cancelled transfer orders are to be reinitiated by OFB immediately.
2.       LDCE Exam to AWM from JWM with minimum 3 years qualifying period through UPSC is to be introduced immediately to strengthen the organization with experienced & field oriented skillful officers.
3.        Cadre Review for JWM should be made at the earliest along with outside Govt. Agencies like BHEL, BEL..etc to set up the cadre review as a industry based organisation.
4.       Training of JWM should be made separately in OFIL through outside faculties. (i.e It should not be combined with CM, LDC, UDC, OS..etc ) and training at Premier Management Institute in INDIA in the line of IOFS in Abroad.
5.       Logical & Transparent Transfer Policy should be made for JWMS by OFB at the earliest.
