LETTER FOR TEMPORARY DUTY FOR BGCM-2016

GENERAL SECRETARY VISIT TO OFB AND MOD

DEAR MEMBERS,
GENERAL SECRETARY VISITED OFB, KOLKATA ON 18TH & 19TH AND TO MOD ON 20TH JANUARY 2016. FOLLOWING POINTS WERE TAKEN UP WITH DGOF FOR EARLIEST RESOLUTION.

1. Deferment in date of promotion of JWM ( JWM Promotion published on

22/12/2015 by OFB).

2. Cadre Review of JWMs.

3. Seniority list of JWMs.

4. Honorarium/Incentive Scheme,Risk Allowances,NDA for JWMs.

DGOF/CHAIRMAN ASSURED TO GRANT THE MEETING AT THE EARLIEST AND ASKED CLARIFICATION ON THE ABOVE POINTS TO MEMBER PER BY 20-01-2016.

DURING THE DISCUSSION WITH DDG/NG HE EXPRESSED THAT OUR PROPOSAL FOR JWM TO 7TH CPC WAS APPROVED BY THE SECRETARY/MOD AND IT WAS FORWARDED TO MOF FOR FURTHER PROCESS. THE PROPOSAL ARE AS FOLLOWS.

50% of Junior works Manager of Ordnance Factories in Ministry of Defence may kindly be considered at Grade pay of 4800 which is 08^th level in the Pay Matrix in 7^th CPC. 35% of Junior Works Manager kindly be considered in Grade pay of 5400(PB-II) in level 09 and 15% at 5400(PB-III) in level 10 with Non Functional Up gradation (NFU).

DEAR MEMBERS,
REGARDING DEFERMENT PROMOTION DATE OF JWMs MEMBERS OF THIS ASSOCIATION HAS FILED CASE AT PRINCIPAL BENCH NEW DELHI AND CENTRAL ADMINISTRATIVE TRIBUNAL, NAGPUR BENCH. BOTH THE HONORABLE TRIBUNAL HAS GRANTED STAY ORDER ON DEFERMENT OF PROMOTION DATE.

IN THIS REGARD CE HAS GIVEN LETTER YESTERDAY TO HONORABLE DEFENCE MINISTER WHICH IS FURNISHED BELOW.

Respected Sir,

Reference cited, it is deeply regretted that OFB has published promotion to JWM along with deferment in dates of previous promotions (4-5 years beyond from previously published dates)!!Glaring omissions by honorable OFB are highlighted below for immediate resolution please.

1. Ordnance factory Board has published promotion from Chargeman to Assistant Foreman on 31/05/2010 and 28/07/2010.

2. Ordnance factory Board has published an order of merging of post of Assistant Foreman and Junior Works Manager as Junior Works Manager (Group B Gazetted) vides order No. 3265/^6th CPC/IMPL/2011/A/NG Dated-04/02/2011.

3. Ordnance Factory Board has published the promotion order of Chargeman to Junior Works Manager (Consequent upon merger of post Assistant Foreman with Junior Works Manager) vide Order no-3265/RDPC/JWM/2010/A/NG Dated-24/02/2011 and DJWM-15/RDPC/JWM/2010/A/GB/1 dated- 12-09-2012.

4. All the Chargeman those have promoted to Junior Works Manager has continued to perform the duty of Junior Works Manager (Group B Gazetted) as per the order of OFB..

5. Ordnance factory Board has published the seniority list of JWMS in the Year 2014 two times in which all the affected person were shown as JWMs and placed in the seniority list.

All of a sudden OFB has published an order on 22/12/2015 and defer the promotion date of the existing JWM to the year 24/08/2012, 15/11/2012 and 22/12/ 2015 by which nearly 1000 of JWMs date of promotion date was deferred. All the affected JWMS are frustrated and are approaching Court of law at different Central Adminstrative Tribunal for Justice.

Sir, it is relevant to mention here that, if at all there was no vacancy in the post of JWM after 2010 in any Trade, then subsequently promotion would not have granted in the coming year. But it is surprise to note that, OFB has published promotion from Chargeman to JWM in the year 2011 and 2012 and granted the date of Promotion Notional W.E.F 2010. This clearly shows that OFB Officials has made such type of mistake knowingly.

Moreover, Ordnance Factory Board has Filled Vacancy of JWM through LDCE and DR in the subsequent years (2010, 2011, 2012,2013) which was knowingly carried out by OFB Officials.

Now, Ordnance Factory Board has published the Deferement of Promotion date of nearly 1000 of JWMs without furnishing the proper reason and the individuals were not given opportunity of hearing and submission of representations.

Sir, from the above it is observed that OFB Officials has taken their own decision for promotion and Seniority of Group B cadre of Ordnance Factories and made continual mistakes. Because of their mistakes many Group B employees were frustrated and approaching Honorable Central Administrative Tribunal of different benches. These will not only cause the unnecessary expenditure for the individuals but also to the Govt. of India.

Therefore, the Central Executive Committee of this Association requests your kind intervention in the matter and suitable action may kindly be initiated against the OFB Officials those have done the above mistake. It will be better to deduct the court fees expenditure from the salary from OFB Officials those have done the above mistakes.

LETTER FOR DEFERMENT IN DATE OF PROMOTION

Respected Sir,

1. Review DPC should not have been delayed by OFB for five years. Had review DPC been completed within one year, this current omission could be having been avoided.

2. Erstwhile AF that was merged/promoted to JWM, performed the duties of the higher posts from the date of publication.

3. Mass Promotions from CM to JWM in all trade were ordered by OFB in 2010 which is nothing short of administrative goof-up that was never set right.

4. The huge financial loss of OTA, Bonus etc in Non- Gazetted cadre has been lost to those JWM who were promoted in 2010 and now deferred. If this is not absolute callousness and total disregard for the cadre of JWM, then what is?

5. Many AF became JWM because OFB made the “smart” decision of merging the posts and not by promotions. Now OFB has become over-smart by deferring their so-called promotion dates. Is this not disrespecting the post and cadre at the same time?

6. If there had not been any irregularity in promotion to the post of JWM from CM by OFB, then a chargeman could have well competed for the post via LDCE without waiting for OFB’s magic date of 22/12/2015.

7. The Draft Seniority List of Chargeman has been published on 10-08-2015 and without publishing Final Seniority list. O F Board has published directly Promotion Order with deferment in date from 2010 onwards.

8. Due to review DPC the promotional notional date for many JWM is postponed to later date (04-05 years later), If so, what was the strength of chargeman considered in DPC for that previous years for giving promotions to chargeman from feeder post or through LDCE? Why not review DPC for all feeder posts?

9. In the latest promotion list many juniors have become seniors and vice versa which has resulted in disillusionment, isolation and victimization.

It is noted with deep regret that OFB is not serious regarding Group B cadre ( Chargeman and JWMs) leave along its promotion. Implementation of 7th CPC is due in 01/01/2016 but OFB has not been able to get the Seniority of Chargeman and JWM right, till date. Every time OFB publishes a seniority list of the above cadre, there is goof-up and these results in associations forced to approach the honorable courts for settlement. Why is OFB so fond of harassing our cadre? Sometimes it is felt that there is a separate department that spends its entire working time on devising mew ways and means to stamp out the Group B cadre.

The Central Executive Committee of this Association requests you not to defer the promotion date of any JWM and also grant promotion of Chargeman to JWM on the same date (31/05/2010) as per review DPC and then correct the seniority list of JWM accordingly. Last but not the least; this Association cannot help ponder whether OFB would ever dare make such hateful omissions to the Group A cadre.

Please advise OFB to be just and correct at the same time so that such mistakes do not happen in future.
